Profile

Matthew Pascall is a member of our commercial team, specialising in employment law and is also a member of our personal injury team.

 

Along with over 25 years experience, Matthew brings an un-stuffy but focused approach to his work. He is a good communicator who recognizes the need to give practical, sound, advice.

 

Employment

His employment practice ranges from routine unfair dismissal to sex, race and disability discrimination claims. He has acted for large multi-national corporations, local authorities as well as individual employees. He was involved in the Gate Gourmet litigation and recently represented the successful appellant in Rustamova v. Governing Body of Calder High School in the EAT, a case that has attracted national interest.

 

He is currently involved in two cases for a local authority in which the employer’s new absence through ill-health policy has been under scrutiny in situations where employees have been dismissed following long periods of absence caused by ill-health. 

 

Personal Injury
His PI practice includes clinical negligence alongside employer’s liability, public liability, road traffic and Fatal Accident Act claims. The bulk of his practice is claimant focused but he also undertakes defence work. His PI practice varies between routine work involving accidents at work, RTAs and public liability and more complex claims.

 

An example of his clinical negligence practice involved a claim brought by an HIV + claimant who developed paralysis following a lumbar puncture procedure. The case involved a range of experts in AIDS, hematology and orthopedics.

 

Matthew also has a particular interest in complex stress at work claims. He has also recently advised in a complex claim for negligence against a local authority arising out of its alleged failure to take the claimant into care as a child.


Matthew is a member of Chamber’s new Education Law Group with a particular interest in education negligence and PI claims associated with educational institutions. Along with other members of the Group he contributed to the Education Law volume of Atkins Court Forms.
